Article 1. General information and acceptance

Marina’s Jungle Gems es una tienda online de plantas naturales criadas y aclimatadas en casa. Titular: Marina Sánchez, NIF 41556347Q, Girona (España). Contacto: info@marinasjunglegems.com.

Using this website and placing an order imply acceptance of these Terms and Conditions, the Shipping Policy and the Privacy Policy.

Article 2. Products

We sell natural plants, corms and accessories. Every plant is a living thing and a unique specimen: photos show the actual specimen or a representative one from the same batch, and there may be small natural variations in size, colour or number of leaves. These variations are not considered a defect.

We work in small batches with limited stock. If, due to an occasional error, a product were unavailable after your purchase, we will let you know and refund the full amount.

Article 3. Purchase process

When you complete an order you are making an offer to purchase. The order is accepted once we confirm the payment and send you the confirmation email. Bizum orders remain on hold until we verify the payment.

We reserve the right not to accept an order due to lack of stock or an obvious pricing error; in that case we will let you know and refund any amount paid.

Article 4. Prices and payment

All prices are shown in euros and include applicable VAT. Shipping costs are shown before you confirm your order. You can pay by Bizum or PayPal (which also accepts card payments).

Article 5. Shipping

Shipping is governed by our Shipping Policy. In short: we ship only on Mondays and Tuesdays, to mainland Spain and European Union countries, and we may hold back a dispatch due to extreme weather conditions to protect the plant. We do not handle phytosanitary certificates, so we do not ship to countries or territories that require these import or export documents.

Article 6. Right of withdrawal

Natural plants are goods that can deteriorate quickly, so they are exempt from the 14-day right of withdrawal, in accordance with article 103 d) of Spanish Royal Legislative Decree 1/2007 (General Law for the Defence of Consumers and Users).

For non-perishable items (pots and accessories) you do have 14 calendar days from receipt to withdraw without giving any reason, returning the item in its original condition. Return costs are borne by the customer, and we will refund the amount within a maximum of 14 days of receiving the item back.

Article 7. Warranties

All plants travel with our good-condition arrival guarantee, described in the Shipping Policy: if a plant arrives damaged, let us know within the first 24 hours with an unboxing video and photos, and we will resolve it with a replacement or a refund.

Non-perishable items are also covered by the legal conformity warranty provided for in consumer regulations.

Article 8. Complaints and dispute resolution

Si algo no va bien, escríbenos primero a info@marinasjunglegems.com: lo resolvemos de buena fe y con rapidez. Como consumidor puedes acudir además a los servicios públicos de consumo de tu comunidad autónoma o a las Juntas Arbitrales de Consumo.

Article 9. Intellectual property and use of the website

The texts and photographs on this website are our own. Their reproduction or commercial use without permission is not allowed. We do our best to keep the website working properly at all times, but we cannot guarantee uninterrupted availability.

Article 10. Applicable law

These terms are governed by Spanish law. Nothing herein limits the rights that consumer regulations grant you as a consumer, including the jurisdiction of the courts of your place of residence.
